Terms & Conditions

1. Who you're contracting with

Locaia is operated by MapPulse, a sole proprietorship ("we", "us", "Locaia"). We provide a mobile-first discovery platform for local places, including a consumer app and tools for verified business owners (the "Service"). By using the Service, you enter into a contract with MapPulse trading as Locaia.

2. Acceptance

By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are at least 13 years old (or the minimum age in your country), and if you accept on behalf of a business, that you have authority to bind it.

3. Your account

You're responsible for keeping your credentials confidential and for activity under your account. Keep your account information accurate and up to date.

4. Acceptable use

You must not:

  • use the Service unlawfully or for fraud, spam, harassment, or impersonation;
  • infringe anyone's intellectual property or privacy rights;
  • upload malware, probe or scan the Service, or scrape it at scale;
  • interfere with security features or circumvent technical limits.

5. Ownership

Locaia, including its software, design, branding, and content we publish, is owned by Locaia and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

6. Your content

You retain ownership of content you submit (e.g. places, photos, collections, reviews). You grant Locaia a worldwide, non-exclusive license to host, display, and adapt that content solely to operate and improve the Service.

7. Service level

We work hard to keep Locaia reliable but don't guarantee that it will be uninterrupted, error-free, or available everywhere. To the fullest extent permitted by law, we disclaim implied warranties including merchantability and fitness for a particular purpose.

8. Payments and subscriptions

Paid plans are billed monthly or yearly as selected at checkout. Payment, billing, tax, cancellations, and refunds are handled by our reseller, Paddle. Please refer to Paddle's Buyer Terms for the commercial terms of your purchase, and to our Refund Policy for our refund window.

9. Reseller disclosure

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, sections that by their nature survive (ownership, disclaimers, liability, governing law) will continue to apply.

11. Liability

To the maximum extent permitted by law, Locaia's aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us (via Paddle) in the 12 months before the event giving rise to the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify Locaia against third-party claims arising from your content, your use of the Service in breach of these Terms, or your violation of law.

13. Changes

We may update these Terms from time to time. If changes are material, we'll notify you in-app or by email. Continued use after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the seller's place of residence, without regard to conflicts of law principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory local law gives you the right to bring a claim elsewhere.
